Mobility Device Access Policy

Purpose
LWSRA is committed to providing equal access to its programs, services, activities, and facilities in compliance with the Americans with Disabilities Act (ADA) and Section 504 of the Rehabilitation Act.

This policy explains the use of wheelchairs, mobility aids, and other power-driven mobility devices by participants and visitors.

Wheelchairs and Traditional Mobility Aids
Individuals with mobility disabilities may use:

  • Manual wheelchairs
  • Power wheelchairs
  • Mobility scooters
  • Walkers, crutches, canes, and similar devices in any area open to the public.

These devices are permitted at all times and are not subject to additional restrictions beyond general safety rules applicable to all visitors.

Other Power-Driven Mobility Devices (OPDMDs)
An OPDMD is any mobility device powered by batteries, fuel, or other engines that is used by an individual with a mobility disability for locomotion but is not a wheelchair.

Examples may include:

  • Segways
  • Golf carts
  • Certain electronic personal assistive mobility devices

LWSRA will permit OPDMDs unless a particular device cannot be accommodated due to legitimate safety concerns.

Assessment Factors
In determining whether an OPDMD may be used in a specific area, LWSRA will consider:

  • The type, size, weight, and speed of the device;
  • Pedestrian traffic volume;
  • The facility’s design and operational characteristics;
  • Safety requirements necessary for safe operation; and
  • Whether the device poses a substantial risk of serious harm to the environment or others.

Credible Assurance
If it is not apparent that an OPDMD is used for a mobility disability, LWSRA staff may request credible assurance.

Credible assurance may include:

  • A valid state-issued disability placard or card; OR
  • A verbal statement that the device is used due to a mobility disability.

LWSRA will not inquire about the nature or extent of the disability.

Safety Rules
Operators of mobility devices must:

  • Maintain control of the device at all times;
  • Operate at a safe speed appropriate to the environment;
  • Follow posted facility rules;
  • Refrain from reckless or dangerous operation.

Additional reasonable restrictions may apply in certain areas if required for safety.

Operational Safety Standard
OPDMDs must be operated in a careful and prudent manner that does not endanger the safety of the operator or others. LWSRA may limit speed or restrict use in specific areas when necessary to address legitimate safety concerns based on pedestrian traffic, facility design, or environmental conditions.

Removal of Device
A mobility device may be restricted or removed if:

  • It is operated in a dangerous or reckless manner;
  • It poses a direct threat to the safety of others;
  • It fundamentally alters the nature of the program or activity.

If removal is required, LWSRA will work with the individual to determine whether other reasonable modifications can be provided.
